1. Acceptance of Terms
By accessing or using ShowUpNow ("the Service") at showupnow.app, you agree to be bound by these Terms of Service. ShowUpNow is a product created and operated by Cloud Core Consultancy LLC (EIN 392155461), Houston, TX. If you do not agree to these terms, please do not use our service.
2. Description of Service
ShowUpNow is a SaaS appointment booking and no-show protection platform for beauty and wellness businesses. The Service allows businesses to:
- Create a public booking page and accept online appointments
- Collect deposit payments (20% of service price) from clients
- Send automated SMS and email appointment reminders
- Manage appointments, clients, and payments via a dashboard
3. Account Registration
To use ShowUpNow as a business, you must:
- Provide accurate and complete registration information
- Maintain the security of your password
- Be at least 18 years of age
- Be a legitimate beauty or wellness business owner
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use at info@showupnow.app.
4. Subscription Plans and Billing
ShowUpNow offers the following plans:
- Free: $0/month — 1 year free, unlimited appointments, no deposits, ShowUpNow branding
- Starter: $19/month — Unlimited appointments, deposits, 3 staff seats, 100 SMS/mo
- Pro: $32/month — Everything in Starter, 6 staff seats, 500 SMS/mo, remove branding, custom colors
- Agency: $97/month — Unlimited seats and locations, white-label, 5000 SMS/mo
Subscriptions are billed monthly or annually. All payments are processed securely by Stripe. Prices may change with 30 days notice. Annual plans are non-refundable after 14 days.
5. Free Plan Terms
The free plan is available for 1 year from the date of registration. After 1 year, your account will require an upgrade to a paid plan to continue accepting bookings. We will notify you 30 days and 7 days before your free plan expires.
6. Deposit and Payment Processing
ShowUpNow facilitates deposit collection between businesses and their clients through Stripe Connect. Deposits are set at 20% of the service price.
- Deposits are held by the business's connected Stripe account
- ShowUpNow does not hold or control client funds
- Refund decisions are made by the business owner per their cancellation policy
- Businesses are responsible for their own refund and cancellation policies
- ShowUpNow is not liable for disputes between businesses and clients
7. SMS Messaging
By using ShowUpNow, businesses agree to use SMS notifications only for transactional purposes (confirmations, reminders, cancellations). Promotional SMS is available on Pro and Agency plans only. Businesses must ensure client consent before sending SMS messages. All SMS messages must comply with applicable regulations including TCPA and CTIA guidelines.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Send spam or unsolicited messages to clients
- Misrepresent your business or services
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use the Service to collect payments for illegal services
We reserve the right to suspend or terminate accounts that violate these terms.
9. Intellectual Property
ShowUpNow and its original content, features, and functionality are owned by Cloud Core Consultancy LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload (portfolio photos, business information). By uploading content, you grant ShowUpNow a license to display it on your booking page.
10. Cancellation and Termination
Business accounts: You may cancel your subscription at any time from your dashboard. You will retain access until the end of your billing period, after which your account will be downgraded to the free plan.
Termination by ShowUpNow: We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason with reasonable notice.
Upon termination, your booking page will be deactivated and client data will be retained for 90 days before deletion.
11. Limitation of Liability
ShowUpNow provides the Service "as is" without warranties of any kind. To the maximum extent permitted by law, Cloud Core Consultancy LLC shall not be liable for:
- Client no-shows or lost revenue
- Payment disputes between businesses and clients
- SMS delivery failures due to carrier issues
- Data loss or service interruptions
- Any indirect, incidental, or consequential damages
Our maximum liability is limited to the amount you paid us in the 3 months prior to the claim.
12. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Houston, Texas.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email. Your continued use of ShowUpNow after changes constitutes acceptance of the new Terms.
